REFUND FOR BEATS

Buzzin will not provide a refund for Beats, Sound Packs, or Personal Services if access is denied by law. This includes when access is removed from a buyer's collection through a mobile app. Buyers are responsible for any risk associated with denied access.

1. Basic - Non-Exclusive License

  • Price CA $20 Details:
    • This lower price point makes the license accessible to indie artists and those on a budget.
    • you can always upgrade.
  • Description: A Basic License typically offers limited access to the beat for low-budget projects or indie artists. This type of license may come with restrictions on usage
    • Limited Sales: Allows the artist to sell up to a specific number of copies (e.g. 2,500).
    • Non-Exclusive Rights: The producer can still sell the beat to other artists.
    • Basic Commercial Use: Allows the artist to use the beat in personal projects, demos, or small scale releases.
    • Credit Requirement: Artist must credit the producer in their releases.
  • This first license means that a single beat can be used by multiple artists at the same time. “How does that benefit me as a producer?” Basically, you can have unlimited artists lease the same beat over and over which is great because you can make an unlimited amount of money off of non-exclusive licenses. You can continue to license a beat as many times as your heart desires until you either decide to sell exclusive rights to that beat or take it down for whatever reason. Another great thing about non-exclusive licenses is that you can create certain tiers of those licenses. A lot of producers that you come across, like on Airbit, will have anywhere from two to four types of licenses with different terms and tiers. These tiers give artists the flexibility to choose how they want to utilize the beat and work with their budget. For example, you may see a basic tier which just includes an MP3 and a certain amount of downloads or streams. If the basic tier doesn’t give you the right to use the beat for a music video, the person interested in purchasing it may opt for a higher tier if they do want to utilize it in a music video. Higher tiers typically include a WAV file along with additional downloads, non-profit/for-profit performances, etc. (aside from everything already included in the basic tier)

2. Unlimited - Exclusive License

  • Price CA$40
  • This mid-range price reflects the additional value and flexibility provided to the artist.
  • Description: An Unlimited License provides broader access, allowing more flexibility for artists to use the beat in various projects without many restrictions.
    • Unlimited Sales: The artist can sell an unlimited number of copies of the song/track.
    • Non-Exclusive Rights: While the artist can use the beat widely, the producer can still license it to other artists.
    • Multiple Uses: Artists can use the beat in various types of projects like songs, commercials, or film scoring.
    • Earnings Retention: The artist keeps all earnings made from the song, providing ample financial incentive.
  • This license means if anyone purchases exclusive rights to a beat, they are going to be the last artist to make that purchase. Usually, that purchased beat gets taken down from a producer's beat store because it cannot be sold to any other artists again. Aside from any potential backend royalties from performances, the upfront fee/sale of the beat is the only money you’ll make from a beat sold exclusively. As a result, beats that are sold exclusively typically have a higher price tag so that the producer who’s selling them can maximize their revenue at the point of sale.

3. Premium - Sync License

  • Price CA$88
  • This higher tier comes with exclusive rights and additional benefits, justifying the higher price.
  • Description: A Premium License offers comprehensive rights, usually at a higher price point, and often targets serious artists or businesses looking for exclusive access.
    • Exclusive Rights: The beat is sold to only one artist, meaning no one else can use it.
    • Unlimited Usage: Similar to the Unlimited license but with the added benefit of exclusivity.
    • Higher Quality Files: Higher quality audio files (e.g., WAV) instead of just MP3, ensuring the best sound quality.
    • Royalties Sharing: Potential for a profit-sharing agreement depending on sales, opening avenues for collaboration on larger projects.
    • Custom Edits: The artist may have the option to request changes or customizations to the beat.
  • This license gives the permission to sync music to video. For example, for your beat to get placed in TV, film, or some form of media, you would need a sync license (also known as a synchronization license). We have an entire in-depth article and video 

What do The Different Licenses Mean?

There are only really two different types of licenses - Exclusive & Non-Exclusive. We don't allow producers to change the name of the Exclusive License, so if this is what you're looking for, it will always be called this, and this is the only one that is removed automatically.

 

This means that all other licenses, regardless of their name, are Non-Exclusive (this includes Unlimited). If you purchase a Non-Exclusive license, you are only leasing the beat, and the producer can continue to lease the beat to others.

 

If you purchase the Exclusive license you will own the exclusive rights to that beat, and it will be automatically removed from the store so it cannot be sold anymore.

Each license type will have different limits, such as streaming, distribution, etc. It is highly recommended that you preview these terms before committing to a purchase to ensure you get the right license for your needs. You can see how to do this here.

 

Purpose of the License

The Basic License grants the Licensee the right to utilize the services provided by the Licensor, including but not limited to [insert specific services, e.g., music reviews, digital content, educational materials], for personal, educational, or limited commercial purposes as specified within this Agreement.

Duration of the License

  • Effective Date: This Agreement shall commence on the date of payment.
  • License Term: The license is valid for [insert duration, e.g., one year] from the Effective Date, unless terminated earlier in accordance with the terms of this Agreement.
  • Renewal: The License may be renewed upon mutual agreement by both parties. The Licensee will be notified [insert notification period, e.g., 30 days] before expiration.

Rights and Limitations

  • Licensor’s Rights: The Licensor retains all rights, title, and interest in and to the services, including all copyright and intellectual property rights.
  • Limitations on Use: Licensee may not use the services in any manner that violates any applicable laws or regulations.

Termination Clause

  • This Agreement may be terminated by either party under the following conditions:
    • Material Breach: If either party fails to comply with any material term or condition of this Agreement and does not cure such breach within [insert cure period, e.g., 30 days] after written notice, the non-breaching party may terminate this Agreement.
    • Non-Payment: If the Licensee fails to pay any amount due under this Agreement, the Licensor may suspend or terminate the License immediately.

Liability and Indemnification

  • Limitation of Liability: The Licensor shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with this Agreement, even if advised of the possibility of such damages.
  • Indemnification: Licensee agrees to indemnify and hold harmless the Licensor from any claims, losses, liabilities, damages, costs, or expenses arising from the Licensee's use of the services, including any violation of this Agreement.

Governing Law

Entire Agreement
